Guardianship
Choosing a guardian for your minor children is an important aspect of a comprehensive estate plan. Our attorneys will help you decide who the best guardian is for your children keeping in mind that sometimes family members are not the best fit as their philosophies on children rearing might be dramatically different from your own.
What is a Guardianship?
In California, a guardian is appointed by a probate judge to be responsible for a child under the age of eighteen. Guardians are appointed when a parent is terminally ill, unfit, or upon the death of both parents. At Burt + Clerc our attorneys can advise you on the rights and responsibilities of guardianship variations, and can file and pursue a petition in probate court. We can also advise you on alternatives to guardianship that may accomplish your goals and desires without the necessity of court intervention.
